Welcome to Hey Habit Tracker ("the App"), developed and operated by Resource Highway LLC ("we," "us," or "our"), a company based in North Carolina, United States. By downloading, installing, or using the App, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the App.
These Terms constitute an agreement between you and Resource Highway LLC — not between you and Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
1. Description of Service
Hey Habit Tracker is a voice-first habit tracking application for iOS. The App allows you to log habits using your voice or manual input, view progress over time, and gain insights into your habits. All habit data is stored locally on your device. We do not collect, transmit, or store your habit data on any external server.
Health & Medical Disclaimer: The App is a habit tracking tool and does not provide medical, health, or fitness advice. Any health-related insights, metrics, or habit categories displayed by the App (including but not limited to fitness, nutrition, sleep, or wellness habits) are for informational purposes only and should not be considered a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider with any questions regarding a medical condition.
2. Eligibility
You must be at least 13 years of age (or the minimum age required in your country of residence) to use the App. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. The App does not require account creation, and we do not collect personal login credentials.
3. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions. This license does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.
4. Voice Input and Speech Recognition
The App uses Apple's on-device speech recognition to process voice input for habit logging. No audio recordings are transmitted to or stored by Resource Highway LLC. Voice processing occurs entirely on your device using Apple's Speech framework. Apple's own terms and privacy practices govern the speech recognition service. No audio data is retained by the App after your spoken input has been converted to text.
5. Subscriptions and Payments
The App offers optional auto-renewable subscription plans that unlock premium features. By purchasing a subscription, you agree to the following terms:
Subscription PlansWe offer a monthly plan (1-month duration) and an annual plan (1-year duration). Current pricing for each plan is displayed on the subscription screen within the App and on the App Store product page.
PaymentPayment will be charged to your Apple ID account at confirmation of purchase.
Free TrialIf a free trial is offered, you may use the subscription features at no charge for the trial period. Any unused portion of the free trial period will be forfeited when you purchase a subscription. Eligibility for a free trial is determined by Apple's introductory offer rules.
Auto-RenewalYour subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription rate.
Managing SubscriptionsYou may manage your subscription and turn off auto-renewal at any time by going to your Account Settings in the App Store after purchase.
CancellationYou may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
RefundsRefund requests are handled by Apple in accordance with Apple's refund policies. We do not process refunds directly.
All subscription transactions are processed by Apple through the App Store. We do not collect or have access to your payment information.
6. Privacy and Data
Your privacy is central to how we build and operate the App. We do not collect personally identifiable information. Habit data remains on your device and is never transmitted to us or any third party. For full details, please review our Privacy Policy.
The App uses Sentry, a third-party crash and performance monitoring service, to help us identify and fix technical issues. All crash report data is anonymized before transmission. No habit data, health information, voice recordings, or personal identifiers are included in crash reports. Only anonymous technical data such as device platform, error events, and session information is collected.
7. Your Data
You retain full ownership of any data you create within the App. Since all data is stored locally on your device, you are responsible for maintaining backups. We are not liable for data loss resulting from device failure, app deletion, or any other cause. The App may provide data export functionality to help you maintain your own records.
8. Intellectual Property
All content, design, code, graphics, and trademarks associated with the App are the property of Resource Highway LLC or its licensors. Except for the limited license granted in Section 3, you may not copy, modify, distribute, sell, or reverse-engineer any part of the App without our prior written consent, except to the extent expressly permitted by applicable law.
9. Acceptable Use
You agree not to:
- • Use the App for any unlawful purpose
- • Attempt to reverse-engineer, decompile, or disassemble the App, except to the extent expressly permitted by applicable law (including EU Directive 2009/24/EC regarding decompilation for interoperability)
- • Interfere with or disrupt the integrity or performance of the App
- • Attempt to gain unauthorized access to any systems or networks connected to the App
10. Disclaimers
The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's reliability, accuracy, availability, or fitness for a particular purpose.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Resource Highway LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to loss of data, loss of profits, or personal injury, even if we have been advised of the possibility of such damages.
12. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Resource Highway LLC, its officers, directors, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.
13. Termination
We may suspend or terminate your access to the App if you violate these Terms. Upon termination, your right to use the App ceases immediately. If we terminate your access without cause during an active paid subscription period, you may be entitled to a refund through Apple in accordance with Apple's refund policies. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and the Apple provisions in Section 16 survive termination.
14. Changes to These Terms
We reserve the right to update or modify these Terms at any time. If we make material changes, we will update the "Effective Date" at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions, except where mandatory consumer protection laws of your country of residence provide otherwise. Any disputes arising under these Terms shall be resolved in the state or federal courts located in North Carolina, subject to applicable mandatory jurisdiction rules in your country of residence.
16. Apple-Specific Terms
The following terms apply to your use of the App as downloaded from the Apple App Store:
AcknowledgmentThese Terms are between you and Resource Highway LLC only, and not with Apple. Resource Highway LLC, not Apple, is solely responsible for the App and its content. These Terms do not provide for usage rules for the App that are in conflict with the Apple Media Services Terms and Conditions.
Scope of LicenseThe license granted to you for the App is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
Maintenance and SupportResource Highway LLC is solely responsible for providing any maintenance and support services for the App, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
WarrantyResource Highway LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Resource Highway LLC.
Product ClaimsResource Highway LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
Intellectual Property ClaimsIn the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Resource Highway LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Legal ComplianceYou represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-Party Terms of AgreementYou agree to comply with all applicable third-party terms of agreement when using the App, including but not limited to your wireless data service agreement and the Apple Media Services Terms and Conditions.
Third-Party BeneficiaryApple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
